It’s quite possible. As is so often the case, they likely wouldn’t be so due to any legal exemption so much as due to a failure (or refusal) to hold them legally accountable. We’ve seen officers of the law in the show before so we can already say for a fact that they have some manner of law. Between their similarities to ourselves, their capitalist economic structure and the basic rules needed to maintain a civilized society, we can further speculate that that they would at least have laws regarding property damage. Think back to just how much destruction their antics have led to over the years. Twilight’s use of magic to alter the fundamental nature of the parasprites, for instance, directly led to the whole damn town being eaten. Hell, there’s probably laws against using such magic without official authorization to prevent that very kind of thing.
So your saying that the Mane Six, are above the law then?
To be fair, that could also just be one of the benefits of being simultaneously a celebrity, a living weapon upon which the entire world depends and a personal friend of all three princesses as well as the rulers of another major state (who are themselves also very closely acquainted with the afore mentioned princesses). If you’re the local sheriff, constable or whatever, are you really even going to bother trying to put her away? It would be like trying to successfully divide by zero without breaking physics.

Most of the other unicorns in her class can’t use magic either.
Cutiemarks are completely different we have seen that full grown ponies can not have cutiemarks either it’s not physical it’s discovering yourself which someponies take longer to understand.
It’s not picking on her it’s taking the evidence we have and making a logical conclusion we know handicapped ponies exist and it’s possible she could be and it’s not something people point and laugh about most fans see it as an obstacle she will find a way to overcome that’s like saying we’re making fun of people in wheelchairs because we came to the conclusion they can’t walk.
