Okay, that has nothing to do with my statement.
I was telling that BP that when he said “average consumer could very likely mistake it for an official product” it’s not really true as they have disclaimer that is saying “hay, this isn’t official”, I’m not talking about legal stuff at all.
And I was talking about how there’s convoluted legalese that interprets that information as an attempt to cover asses.
Again, I was talking about how it informs CONSUMERS.
That has a specific name in legalese and can be used to prove intent in the eyes of some lawyers.
I wasn’t talking about in law, I was talking about how it informs consumers it’s not an official product.
That’s not enough. There’s tons of fan-made artworks that are very similar to the original art.
Jan just couldn’t afford to fight charges in a court, even if he could have won.
The same happened to Fighting is Magic (with the addition that it associated fighting with MLP, which wasn’t quite what Hasbro wanted - but Button Mash’ Adventures?! Dammit!).
Even when they put a disclaimer that it’s fan mad and not official.

And I think it was completely justified. Shitty on Hasbro’s part, but justified. The animation quality and length of the “episodes” was such that the average consumer could very likely mistake it for an official product.
It’s not surprising that Hasbro shut it down. Same thing as with Fighting is Magic: A very high quality product that consumers could easily mistake for an official product.
Yeah, that would be “fair use”.
But then again, it’s more about the copyright holder’s powers. Even if Jan wasn’t at fault, he couldn’t do anything but comply.
In Russia, he could have replied with a good laugh, maybe.

if seems as long you don’t gain a profit from it, you can do what you want.
I guess it’s because in Russia you can violate copyrights without risking your artistic career.
