No, they haven’t. To summarize my previous post, look up the term ‘trade dress’. Most fanworks are arguably fair use alterations, but nobody has had the money to litigate that to establish case law. Imitating commercial trade dress is a lot less of a grey area.

Yeah, this is the one thing an artist should actually step very very carefully around. Making official looking packaging is a good way to get the bad kind of attention.
 
The only fanworks thing the Pokemon group gets touchy about is ‘official-looking’ packaging/tags, because bootlegs.

If this is an independently-made mock-up of a Funko product, this might actually qualify in the very illegal indeed category of copyright and/or trademark abuse.
