If you’re meaning what I think you’re meaning, you have your facts wrong. A lot of early Nyx stuff was recolored, and I will agree it’s not the best look, but it wasn’t Penstroke’s intention for people to recolor things for her. It’s just something that happened out of his control.  
If you’re meaning the literal body as in the general pony shape, that’s an even less good argument, as that would then apply to every pony OC.
 
A lot of old fandom art had a lot of recolors, you can see this if you look into “bad OCs” even today. That’s not me saying Nyx is a bad OC, quite the opposite, a lot of people wanted to make “art” and many of them unfortunately didn’t actually draw themselves and used other methods, such as recoloring. Maybe even tracing.
 
I garuntee if you look up art for a lot of the other big pony OCs that followed a more simplistic apperance, you’d probably find a lot of recolor artwork there.
 
Finally, Past Sins was a fanfic, not a visual novel, Nyx’s apperance while given guidelines from the texts on rough apperance; was subject to the person drawing her. As a result many people had different ideas on what she would look like, while trying to remain true to the source material. And yes, to some that might even be recolors.
 
In fact, you can still draw Nyx in your own style or interpretation today, be it as an alternative universe version, or simply how you envisioned her realistically or unrealistically in your story. Pretty much in the same why Petirep did with his Rainbow Dash Presents characters. Though admittively he did have freedom with the characters personalities too. One thing I should probably note is Past Sins does have official artwork commissioned and approved of by Penstroke. Due to this fact; some people might find themselves drawing Nyx as depicted in this artwork as it feels the most official, but again I must remind you, there’s nothing wrong with straying from the established or populist view. It might very well become the next big hit that takes over from the old, as was the case with Luna in Season 2.

It’s because the person who first created the Nyx OC pretty much forbade anyone to do anything erotic with her. And for years most artists that have used her complied. Which is why there is very little erotic fan art of her. Even I have dared not touch her in my art for fear someone will threaten me with legal shit. Sure she’s an OC. But legal ownership is questionable at best. I mean she’s a literal parody of Nightmare Moon that lives in a universe owned by Hasbro and doesn’t even use an original design base. Other than coming up with her name and background, what about her can be legally owned as an OC?
