that’s right. in fact this is before I had followed the 3-color rule.
Besides the nes color limit is 4 and 4 is the transparency. Also there was a youtuber named: “Level UP”, He makes great animations however he often braces the color rules when he makes animations.
keep that in mind.

Maybe these aren’t meant to be NES quality, or the artist isn’t aware of that.
That said, some developers managed to cheat that. Like in “Super Mario Bros. 2/USA” they used a transparency effect on the main characters’ eyes, and placed a small white sprite block behind the character’s heads, in order to color in the whites of their eyes. This is also why they kinda blink/glitch when they stand in front of a door sprite.
