Well, basically you could not do most of the stuff that happens with these little fellas, as we have animal rights.  
But the basic premiss of this whole fluffy stuff is that these are “bio-toys”. (Think on them as hyperadvanced-plushies.) So, human-dna or not, they are not on the same page. (until the majority regards them as “toys”, or “fake animals”)
 
Another thing, basically every living creature built up the same DNA segments, the four nucleoides. So human-DNA is used or not can be considered meaningless - with a good lawer. ;)

Hahaha I wrote about this before, I was in class and I was talking to a professor about Fluffies and she and I sat down and noted which species would have to donate DNA to make a fluffy. They would contain human DNA to be able to speak like they do and understand speech. So by law they would be sentient and protected by law. Of course that wouldn’t stop some of the sicker weird abusers out there from steeling them and torturing them.
