I was writing him on Twitter yesterday, haven’t gotten an answer yet.
If you watch through the video, one aspect that comes into play is the departure of one person that had been in communications with Jan that was looking more hopeful; when that person left, the situation went south.
I don’t necessarily know if it was Vogel but keep in mind that in this period, Vogel did switch from VP of programming to being more directly involved in the show’s production, and as he was certainly championing fan works against Hasbro legal, that could have been the fact.
Hasbro won’t take them down if someone else reuploads them. That’s not the matter here.
What is more effective is to write them and tell them what you think about the whole deal.
And be angry in your letter. Be very angry.
That’s the only language they’ll understand.

Everyone, the time has come! We must show Hasbro the true power of the internet!!! Reupload ALL of Jan’s old vids to your own channels, and make sure Hasbro knows it!!! When they take them down, reupload them on TEN MORE channels!!! Let Hasbro know they can’t stop us!!! Let them know that until they stop preying on innocent fanworks, we will spread the fanworks they hate so much all across the internet!!!

There’s no “like” about it; there ARE bronies who seriously think that way.
YT does most of their work silently, and Jan’s stuff as long it never used show audio or complete video sequences, would not be discovered (YT’s system is based on a digital content fingerprinting system, and while things can be falsely flagged, this is very rare and unlikely). Even stuff that is flagged, YT is the first to act and warns the user “this may be a DMCA copyright violation” and gives them the option of filing a complaint.
I don’t mind that people think Mike Vogel won’t be able to undo any of the C&Ds sent out, or even prevent future ones from being sent. However, I am frustrated that some fans are convinced he made that tweet out of a cynical attempt at damage control, rather than as a sincere statement about trying to help the fandom out. It’s like there are some bronies who think they’re the only people left who genuinely care about the show.
