Also they were hit for copyright not trademark so them defending to protect their property is out as copyrights dont need to be protected like trademarks

you don’t just get money for having a channel you got to have a lot of subs and views on your vids and even then some people decide they don’t want to make money off of YouTube.
Sorry but I don’t think our laws are antiquated, especially since so many people now have no qualms about copying off the work of others and selling it for profit.
I won’t deny that some companies take things too far but there are countless other companies who don’t. People also ignore the fact that Hasbro is quite lenient compared to other businesses like for example Disney, who throws a bitchfit at minor things like mere fanart.
Jan made money off his work, that’s a no no when you’re using characters that don’t belong to you and trademark law means that Hasbro could lose the rights to their characters if they don’t maintain their claim of ownership, it’s how they lost their original MLP characters and a few transformer characters as well.

This new argument you’ve presented is a completely valid one.
Neither side has “moral high ground”. They’re both victims of insanely out of date Copyright/Trademark laws and vicious lawyers who don’t give a shit about ANYONES bottom line but their own.
Then you get to the point where Hasbro is “scared” of us when they get more views in a single day than they do in over a year.
And no, they don’t want people to be passive, that goes against their entire business strategy for a modern organization. They just want people to be active in their approved channels and everything else is gravy.

Using ad hominem is cheap. It’s a way of attacking a person for things that are irrelevant.
I know it sucks, but they really were using Hasbro’s intellectual property. They got too big and Hasbro couldn’t ignore it any more. Same thing happened to Fighting is Magic - once it got massive exposure, Hasbro had to do SOMETHING.
Otherwise it makes it look like Hasbro is letting the copyright lapse, and that would lead to a bad time.
