You know the Japanese copyright laws is two parts, one is the “Author’s Rights”, the auther has control of there own works, but that has nothing to do with fan works, the “Neighboring rights” is the other part and that have to do with things like broadcasters and stuff, once again not covering fan works.
Fan works all depend on how it’s handled and as almost all can be covered by pointing it is a fan work and pointing out who the copyright holder is then it’s not the same as with the other two things.
Unspoken rules, now some original artists add “allow second creation mark” in their artist.

No, Japan’s copy right law is any people can send report to police, and the police have to sue the fan product.
