Yes it does. That’s called copyright infringement in many other situations, and here it may be labeled defamation and/or IP theft. It’s ridiculous, but this is the way copyright laws work in the 21st century :/
Fairly sure you’d need some sort of license to keep people from using it, and getting that protective over a 2 color cartoon pony (which in this case is also a fairly common color scheme) seems a bit silly to begin with.
