@Telaros
“No one cares about Hasbro’s background pony.”
Irrelevent.
“No one said Jan owns that unused-until-became-popular-BECAUSE-of-Jan’s-animations, background pony.”
What made you think I didn’t know that
“The personality and the original characters made around that easy to replace image of a pony does however belong 100% to Jan. HIS character which is STILL called Button Mash, is still very much his property. His creation.”
I’m sorry, but that’s not how copyright works. The model is owned by Hasbro, and thus anything created around it is owned by hasbro.
“The only, only thing, that Hasbro owns is the image we see here of a pony that only made it onto Slice of Life BECAUSE it was a FANDOM shoutout episode. That pony was just a bonus prop there for the fans. If it gets used more? That’s okay. It’s Hasbro’s background pony.”
Yes it is
“It ISN’T Button Mash though.”
Yes it is.
“That character and persona and story belongs wholly to Janimations short of selling off the name and character. That image is not a character, it’s just a pony with a beanie.”
I’m sorry, but that’s not how copyright works. The model is owned by Hasbro, and thus anything created around it is owned by hasbro.
“Jan can still place the quirks and voice onto anything he wants. Continue the love story of a colt with his pretty girlfriend who can just be swapped for any other character. Nothing is stopping Jan from doing any of this stuff and the fandom for the most part don’t care as they’d project whatever they feel like onto anything they want.”
Fine, but he must give it a different name and appearance.
“Point of what, at least I was anyways, is that Hasbro saw something they felt is marketable. So they took it. That’s all. It’s sleazy, but whaha gonna do?”
It’s not sleepy. they owned it, they can do whatever they want with it.
“The pony on the show is not the pony the fandom got into. That was all Jan’s doing. Plain and simple.”
If hasbro hadn’t introduced him in hearts and hooves day, Jan’s video wouldn’t have been made.
“Now if you’re done yelling at your monitor, let’s just enjoy what a wonderful episode this was and call it a day.”
I never yelled at my monitor.

@CrassMetalHead
Well, the character and personality is all his. He can still do pony stuff if he wanted. He just can’t use the stuff that Hasbro claims likeness to.
They are just lucky he hasn’t animated something new yet with HIS character being given an original non-Hasbro controlled body.
If I was Jan, I’d a been animating so much spite towards Hasbro’s lawyers for ages now just to show how much I wasn’t affected by their petty scams to try and steal and build off the popularity the character and its universe went and made the fandom it has now, both the good and its bad.
But Jan is playing too nice. Lawyers aren’t paid to make fair deals. They’re there for profit and getting the most benefit of a situation as best they can. Least far as I’ve witnessed. It’s no coincidence what so ever that they only NOW started to use the background pony that we call Button being considered for use on the show who hasn’t been seen since Ponyville Confidential way back in S2.
Cashgrab Hasbro. Brown Gamer Pony figures now available in stores for $14.99!
@Wiimeiser
Obviously? I don’t think so. Even though they C&D’d Button’s Adventures, they see how popular this character got and they are just putting him in the show again for fanservice.
@CrassMetalHead
That’s how copyright law works, apparently. That’s why Vinyl and Octavia swapped personalities in Slice of Life. Japan works differently, which is why Keine is a teacher.
@CrassMetalHead
Technically speaking, if what Revenant Wings said on >>1002335 is true, then Jan technically owns Button, which is why they hit him with the C&D in the first place.
I personally think they are gonna probably allow Jan to use Button at one point, but I think Hasbro’s waiting for their lawyers to stop screaming at each other in the faces.
I do feel bad that he hasn’t been able to do anything pony/Button related.
Which is weird because half of this site either loves Jan!Button or despises him because “VOICE SUCKS/BUTTON IS WORST CHARACTER/SWEETIEMASH IS HORRIBLE/ectect”. That’s just me though.
@Wiimeiser
More like Jan’s popularity and the brand recognition he created for that character background pony he created a character and whole universe for was so popular many took his work to be official canon.
Now, after so many years of ignoring Jan’s works, Hasbro decided to pull some muscle to use that recognition to reel in those fans and will likely be marketing his toy down the line under a different name. As Janimation owns all rights to the character, just not the specific background pony in the show.
I liked this episode. It uses two different Buttons. The Janimation proper colored version, and the faded brown colored one.
Hasbro milking what they can from the fanon community. People will buy his toys regardless of what name is given as they will project Button Mash onto the toy regardless.

There isn’t just copyright involved, but trademarks as well, and that adds another layer of complexity.
That explains it.
That’s how copyright law works, apparently. That’s why Vinyl and Octavia swapped personalities in Slice of Life. Japan works differently, which is why Keine is a teacher.
For basically giving more depth to abackground character?

People often forget even heroes can fall under that role. Awesome callout. xD

You said antagonist, so…
Not surprising with that design. Shady Daze becomes male Scootaloo everytime.
Once a C&D is in place it can’t be undone. It’s like trying to undo formatting a hard drive.
They’ve obviously got plans for Button and Jan obviously got in the way.
Cotton Cloud, in air right beside Fluttershy.
Not to set off another ‘standing next to each other’ trend, but…
Cotton Cloudy = Fluttershy’s brother?
His mane actually switched from that to his original one during DT’s singing.
I’d question that, since they’re both students in Equestria Girls.
Supports the rumor that she’s Silver Spoon’s mother
