The letter of the law? Sure. Be related with any creature not human is technically bestiality.
 
But that’s only because there are no other sapients on Earth, so humans have never had to make the distinction. The spirit of the law is that only relations with non-sapient creatures is bestiality.
 
Because the implication is that including Equestrian ponies under the auspices of “bestiality” is that Equestrian ponies are then lesser than humans. Which is fine, I guess, if you want to insult them.
 
Just because some people have that idea doesn’t mean they are correct. If you look in any dictionary you will find that “Bestiality” only refers to inferior animals.
