It’s like Christian Weston Chandler copyrighting Sonichu. It wouldn’t stand up for a nano-second in court.
And let me clarify, I mean just the actual character and any other original character that appears in the fic. Not the setting and surely not the other characters.
Well technically speaking he is an original character and could be legally copyrighted. Although I doubt the creator of the fic has filed for copyrights pertaining to this character.

You are SOOOO right. He’s copyrighted. I could totally get sued if I wrote him in a fic.
Except I’d write him as a menacing villain, puppetmaster pulling the strings accurately and intelligently, making him a real threat to our heroes.
…so basically, he’d be unrecognisable and I likely wouldn’t get sued.
