you seem to be implying that it matters whether or not a character is an OC.

I could, and almost did, write a long post about what constitutes fanfiction and OCs. (Short version: if you have to get someone else’s permission to sell it, or if you have to cite ‘parody’ or ‘fair use’, it’s probably fanfiction. OCs do not appear in works that aren’t fanfiction.) What’s relevant to this situation, though, is that, because Mane Six can sell Them’s Fightin’ Herds without going begging to Hasbro, the characters in the game are not OCs. Your Totally Awesome Ungulate Who Hangs Out With Oleander And Arizona Between Matches is an OC.
 
Also, corporate versus personal ownership doesn’t have anything to do with OCness. Harry Potter is not an OC, and J. K. Rowling owns him free and clear.

That too, but technically the cast of TFH are 100% owned by Faust (and Mane6 too, but she probably has more of an ownership rights ratio compared to her previous creations from 2010. Plus, Spike and Applejack would be considered FCs, lol.)

That would make 90% of the FIM cast her OCs as well. So no, they don’t count as an OC when… When… I’ve no actual idea what it is that stops them from being an OC. Maybe when they’re owned by a company rather than a person? Maybe.
