Yeah, from what I have heard, companies in the US (at least) are forced to take legal action if something may infringe on their trademark. If they fail to do so, it would very negatively impact any cases where they would want to defend against someone infringing on it.
So if they don’t enforce a trademark even against someone or something they wouldn’t care about taking action against, someone that actually wants to rip them off can point to any cases where they didn’t defend their trademark to help their case in court.

china has laws about that but very loose enforcement

Stronheim even says that he is named after the Mexican President Santana.
Carlos Santana or whoever doesn’t have the copyright of a name that existed for hundreds of years.
