The owner of Derpibooru is British, as are most of the admins (I think). The servers are based in France. The upload policy follows UK law - this means explicit underage humans art is banned, because UK law makes no distinction between real or drawn CP; it’s all bad. (however, it would technically be legal in America due to how the Supreme Court ruled on the PROTECT Act, although you’d still risk arrest due to local obscenity laws)
 
Long story short, DB follows European guidelines on nipples - it’s “questionable”; whereas an American site would probably err on the side of caution and label it “explicit”.
