There’s more to it than that, though; if fanmade content might realistically be confused for official content by any random person off the street, then the fanmade content is a legitimate threat to the IP owner’s trademark, and the IP owner has every legal and moral right to clamp down on it, whether it was made for profit or not. Laugh at poniesFTW all you want, this fandom does indeed have a massive sense of entitlement when it comes to fan-generated work, but as the owner of the MLP franchise it is 100% the right of Hasbro to control how the public sees it, just like it’s 100% the right of any artist who paints a picture to control how it gets shown to the world. If you put your heart and soul into painting something you really love, and some douchebag decides to trace it and add something to it that you find horrible and offensive and then post it all over the itnernet, wouldn’t you be pissed off about it, even if they weren’t trying to make money off of it? Hasbro has a 100% legit interest in controlling how the public sees the MLP trademark, because if someone turns out something horrible with the MLP brand on it and uninformed people who see it mistake it for official merchandise, it could seriously hurt them as a company; there are plenty of real world examples of fakies being mistaken for The Real Deal and costing companies dearly in lost sales and damaged reputation. The problem is made worse by U.S. trademark law, which says that if a company doesn’t defend its trademarks, any scumbag ripoff company that comes along after that and produces straight up bootlegs and counterfeits can claim in court that the trademark was undefended and therefore they should be allowed to keep churning out cheap Chinese knockoffs without being punished.
